Términos y condiciones
1. Introducción
Bienvenido a Clic Creador. Al utilizar nuestros servicios para el desarrollo de páginas web, aplicaciones (PWA) o cualquier otra solución digital, usted acepta los siguientes términos y condiciones. Le recomendamos leerlos detenidamente antes de iniciar cualquier proyecto con nosotros.
2. Servicios ofrecidos
Clic Creador actúa como una agencia de diseño y desarrollo digital. Nuestros servicios incluyen, pero no se limitan a:
- Creación de páginas web.
- Desarrollo de Aplicaciones Web Progresivas (PWA).
- Integración de sistemas de citas y reservas.
- Configuración de plataformas de pago en línea.
3. Pagos y suscripciones
Nuestros planes constan de un pago inicial por la creación del producto digital, seguido de una suscripción mensual o anual para el mantenimiento y los costos operativos.
- El pago inicial no es reembolsable una vez que el desarrollo ha comenzado.
- La mensualidad cubre los gastos de servidor (hosting), certificado de seguridad SSL, soporte básico y correcciones menores.
- El cliente puede cancelar su suscripción en cualquier momento; sin embargo, al hacerlo, la plataforma dejará de estar disponible en línea.
- Los pagos de suscripción ya procesados (mensuales o anuales) no son reembolsables; al cancelar, el servicio permanece activo hasta el final del período ya pagado.
4. Actualizaciones incluidas en cada plan
Cada plan incluye una plantilla base personalizable con tu marca, colores e información. Antes de elegir el diseño final, se presentan hasta tres propuestas iniciales de diseño. Una vez elegida la versión final, el cliente puede solicitar cambios adicionales según el límite mensual de actualizaciones incluido en su plan: dos actualizaciones al mes en el plan Presencia, tres en el Automatiza, y cuatro en el Crece. Cambios que excedan este límite mensual serán cotizados por separado.
Plazo de entrega: El plazo estimado de entrega (24 a 48 horas en la mayoría de los proyectos) comienza a contar a partir de que el cliente entregue todo el contenido necesario (textos, fotos, logotipo e información del negocio) y se confirme el pago inicial. Retrasos en la entrega de contenido por parte del cliente extienden el plazo en la misma medida.
5. Propiedad intelectual y dominios
Dominios: Incluimos un dominio estándar de forma gratuita durante el primer año. A partir del segundo año, el cliente es responsable del costo de renovación. Los dominios siempre estarán a nombre del cliente si este lo solicita, aunque inicialmente puedan ser administrados por Clic Creador para facilitar la configuración técnica.
Propiedad: Una vez completado el pago de creación, el diseño, la marca y los activos generados para el cliente son de su propiedad. Clic Creador retiene el derecho de mostrar el proyecto en su portafolio público con fines promocionales.
6. Integración con plataformas de terceros
Clic Creador se encarga exclusivamente de la integración técnica con plataformas de pago (Stripe, PayPal, MercadoPago) y otros servicios externos (WhatsApp, Google Maps). La creación, aprobación y mantenimiento de estas cuentas es responsabilidad total del cliente. Clic Creador no es responsable de bloqueos, comisiones o retenciones de fondos por parte de dichos proveedores.
7. Servicio de Recepcionista con IA
El servicio de Recepcionista con IA opera a través de una línea telefónica asignada por Clic Creador. El servicio puede funcionar con el número actual del cliente mediante el desvío de llamadas hacia dicha línea asignada.
- La disponibilidad y el funcionamiento del desvío de llamadas dependen del operador telefónico, proveedor de VoIP, tipo de línea y plan contratado por el cliente. Clic Creador no controla las funciones, restricciones, cargos ni disponibilidad del desvío de llamadas ofrecido por estos terceros.
- Antes de activar el servicio, Clic Creador verificará junto con el cliente la opción técnicamente disponible para su caso. En algunas situaciones, el cliente podría necesitar utilizar un número diferente o la línea asignada al servicio como número principal.
- Cualquier cargo que el operador telefónico del cliente aplique por el desvío de llamadas es responsabilidad del cliente.
- El plan contratado incluye una cantidad de minutos mensuales; los minutos adicionales se ofrecen en paquetes con costo aparte.
8. Limitación de responsabilidad
Clic Creador no se hace responsable de pérdidas de ingresos, lucro cesante o daños indirectos que resulten del uso o la imposibilidad de uso de la aplicación web o página desarrollada. Haremos nuestro mejor esfuerzo por mantener un nivel de disponibilidad (uptime) superior al 99%, pero el cliente entiende que pueden ocurrir fallos en los servidores que están fuera de nuestro control directo.

10. Garantía de resultados
Clic Creador se compromete a entregar el producto digital funcional según lo acordado en el plan contratado. Sin embargo, no garantizamos resultados específicos de ventas, tráfico, posicionamiento en buscadores, ni la obtención de nuevos clientes, ya que estos dependen de factores externos fuera de nuestro control, como el mercado, la competencia y las acciones del propio cliente.
11. Contenido del cliente
El cliente es el único responsable de todo el contenido que entregue para su proyecto, incluyendo fotos, textos, logotipos y marcas. Al entregar este contenido, el cliente declara y garantiza que posee los derechos necesarios para su uso. Clic Creador no será responsable por reclamos de terceros relacionados con derechos de autor o propiedad intelectual sobre el contenido proporcionado por el cliente.
12. Terminación por falta de pago
En caso de que el cliente no realice el pago de su suscripción mensual o anual dentro de los quince (15) días posteriores a la fecha de vencimiento, Clic Creador se reserva el derecho de suspender el acceso y la disponibilidad en línea del producto digital, sin previo aviso adicional. El servicio será reactivado una vez se regularice el pago pendiente.
13. Ley aplicable y jurisdicción
Estos términos y condiciones se rigen por las leyes del Estado de Florida, Estados Unidos. Cualquier disputa que surja en relación con estos términos será resuelta ante los tribunales competentes del Condado de Broward, Florida.
14. Comunicaciones por mensajes de texto (SMS)
Al proporcionar su número de teléfono a Clic Creador / CKLK Home Pro LLC, el cliente acepta recibir mensajes de texto (SMS) relacionados con actualizaciones de servicio, confirmaciones de citas y respuestas a consultas.
- La frecuencia de los mensajes puede variar según la actividad de su cuenta o proyecto.
- Pueden aplicar tarifas de mensajes y datos según su plan de telefonía móvil.
- Puede responder STOP en cualquier momento para dejar de recibir mensajes, y START para volver a suscribirse.
- Puede responder HELP para obtener ayuda o soporte.
- Su número de teléfono no se compartirá con terceros para fines de marketing.

15. Cambios a estos términos
Clic Creador puede actualizar estos términos y condiciones en cualquier momento. La versión vigente estará siempre publicada en esta página con su fecha de última actualización. El uso continuo de nuestros servicios después de una actualización constituye la aceptación de los términos modificados. Para cambios significativos, haremos un esfuerzo razonable por notificar a los clientes activos.
Terms and Conditions
1. Introduction
Welcome to Clic Creador. By using our services for the development of websites, applications (PWA) or any other digital solution, you accept the following terms and conditions. We recommend reading them carefully before starting any project with us.
2. Services offered
Clic Creador acts as a digital design and development agency. Our services include, but are not limited to:
- Website creation.
- Progressive Web App (PWA) development.
- Integration of appointment and booking systems.
- Setup of online payment platforms.
3. Payments and subscriptions
Our plans consist of an initial payment for creating the digital product, followed by a monthly or annual subscription for maintenance and operating costs.
- The initial payment is non-refundable once development has started.
- The monthly fee covers server (hosting) costs, the SSL security certificate, basic support and minor fixes.
- The client may cancel the subscription at any time; however, when they do, the platform will no longer be available online.
- Subscription payments already processed (monthly or annual) are non-refundable; after cancelling, the service remains active until the end of the period already paid.
4. Updates included in each plan
Each plan includes a customizable base template with your brand, colors and information. Before choosing the final design, up to three initial design proposals are presented. Once the final version is chosen, the client may request additional changes up to the monthly update limit included in their plan: two updates per month on the Presencia plan, three on Automatiza, and four on Crece. Changes beyond this monthly limit are quoted separately.
Delivery time: The estimated delivery time (24 to 48 hours for most projects) starts once the client has delivered all the required content (texts, photos, logo and business information) and the initial payment is confirmed. Delays in the client's delivery of content extend the delivery time by the same amount.
5. Intellectual property and domains
Domains: We include one standard domain free of charge for the first year. From the second year on, the client is responsible for the renewal cost. Domains will always be in the client's name if the client asks, although they may initially be managed by Clic Creador to simplify the technical setup.
Ownership: Once the creation payment is complete, the design, brand and assets generated for the client are the client's property. Clic Creador retains the right to show the project in its public portfolio for promotional purposes.
6. Integration with third-party platforms
Clic Creador is responsible only for the technical integration with payment platforms (Stripe, PayPal, MercadoPago) and other external services (WhatsApp, Google Maps). Creating, getting approval for and maintaining these accounts is entirely the client's responsibility. Clic Creador is not responsible for blocks, fees or fund holds by those providers.
7. AI Receptionist service
The AI Receptionist service operates through a phone line assigned by Clic Creador. The service can work with the client's current number by forwarding calls to that assigned line.
- The availability and operation of call forwarding depend on the client's phone carrier, VoIP provider, line type and plan. Clic Creador does not control the features, restrictions, charges or availability of call forwarding offered by those third parties.
- Before activating the service, Clic Creador will check with the client which option is technically available in their case. In some situations, the client may need to use a different number or use the line assigned to the service as their main number.
- Any charge the client's phone carrier applies for call forwarding is the client's responsibility.
- The plan includes a number of monthly minutes; additional minutes are offered in packages at a separate cost.
8. Limitation of liability
Clic Creador is not liable for lost revenue, lost profits or indirect damages resulting from the use of, or inability to use, the web application or website developed. We will make our best effort to keep availability (uptime) above 99%, but the client understands that server failures beyond our direct control may occur.

10. Results
Clic Creador commits to delivering the functional digital product as agreed in the plan. However, we do not guarantee specific results in sales, traffic, search engine ranking, or new customers, since these depend on external factors beyond our control, such as the market, competition and the client's own actions.
11. Client content
The client is solely responsible for all content provided for their project, including photos, texts, logos and trademarks. By providing this content, the client represents and warrants that they hold the rights needed to use it. Clic Creador is not liable for third-party claims about copyright or intellectual property in the content provided by the client.
12. Termination for non-payment
If the client does not pay the monthly or annual subscription within fifteen (15) days after the due date, Clic Creador reserves the right to suspend access to, and online availability of, the digital product without further notice. The service will be reactivated once the outstanding payment is settled.
13. Governing law and jurisdiction
These terms and conditions are governed by the laws of the State of Florida, United States. Any dispute arising in connection with these terms will be resolved before the competent courts of Broward County, Florida.
14. Text message (SMS) communications
By providing their phone number to Clic Creador / CKLK Home Pro LLC, the client agrees to receive text messages (SMS) about service updates, appointment confirmations and replies to inquiries.
- Message frequency may vary according to account or project activity.
- Message and data rates may apply according to your mobile plan.
- You can reply STOP at any time to stop receiving messages, and START to subscribe again.
- You can reply HELP for help or support.
- Your phone number will not be shared with third parties for marketing purposes.

15. Changes to these terms
Clic Creador may update these terms and conditions at any time. The current version will always be published on this page with its last-updated date. Continued use of our services after an update constitutes acceptance of the modified terms. For significant changes, we will make a reasonable effort to notify active clients.
